Notice to New Accounts and Users

If you are creating a new account for KillingIfrit.com with the sole intention to sell Gil, character(s), account(s), and/or in-game item(s) for real life money, you will be immediately banned from the forum and the website.

The Code of Conduct as found below states the following:

10. Advertising
Linking to sites for your own monetary profit or blatant advertising of non-personal websites in general is prohibited. (Linking to referral sites is only allowed in your signature or personal page, in moderation.) Giving sources proper credit for post content is encouraged, however.

Offers to sell or to exchange virtual in-game items and accounts is also prohibited.

It is also against the End-User License Agreement (EULA) you agreed to upon signing up and registering with Square-Enix for an account when you started playing.

Article 2: Data and Privacy
    In the course of your playing the Game and using the PlayOnline Service, you may accumulate certain usage statistics, score information, character traits, performance records and other Game-related data that are stored for you in the Game and on PlayOnline servers (collectively, the "Player Data"). SEI makes no assurances, representations or warranties whatsoever about the accuracy or continuing availability of this Player Data at any time and reserves its right, at any time and from time to time, without notice to you, to delete all or any part of the Player Data. SEI shall have no liability to you or to any third party for any such deletion, and further shall not be held responsible for any complete or partial deletion done or caused by you, any third party, or other act or occurrence beyond SEI's reasonable control, such as a fire, power outage, natural disaster, terrorist act, equipment failure or any other such act or occurrence, whether or not similar to the foregoing.

    YOU DO NOT OWN YOUR ACCOUNT OR CHARACTER OR HAVE ANY PROPERTY RIGHTS TO YOUR CHARACTER OR ITS VIRTUAL ASSETS. YOU MAY NOT SELL, RENT, OR REPRODUCE YOUR CHARACTER OR ITS VIRTUAL ASSETS FOR ANY COMMERCIAL PURPOSE.

    In addition, the Player Data and other information about you are subject to our PlayOnline Service Privacy Policy, which you should review in its entirety and may be accessed under the "Rules & Policies" section of the PlayOnline Viewer and Website. You agree that you will not store or attempt to store any personal information or player data about other PlayOnline users, except to the extent that such storage is an integral part of the Game and necessary in order for you to play the Game.

Article 3: Prohibited Activities and Indemnification

3.1 Prohibited Activities.
You may not use the Game or PlayOnline for any activities that are illegal, fraudulent, or a violation of the rights of any third party. Without limiting the generality of the foregoing, the following acts and activities are strictly prohibited and shall, without prejudice to any other rights or remedies that SEI may have, be cause for immediate termination of your PlayOnline account and your right to play the Game (or any other services) in connection therewith:

( a ) Any activities consisting of selling, purchasing, or exchanging, "gil" (or any other in-Game currency), accounts, characters, "a playerfs time and effort spent playing the Game," or Game items, for value (such as real currency) by any method, including, Internet auctions or other online exchanges;

( b ) The use of the Game for the purpose of, in furtherance of, or in preparation for, committing any illegal acts (e.g., gambling) or otherwise violating any applicable local, state, national or international law, rule or regulation;

( c ) The interference with, disruption of, or "hacking" of, the Game or the PlayOnline Service or any servers, networks or related websites, or the failure to obey any procedures, policies, regulations or other requirements of any networks connected to the PlayOnline Service;

( d ) Any intellectual property infringement or trade secret violation; this includes the unauthorize use, duplication, transmission, display, performance or distribution of any intellectual property relating to the Game or PlayOnline Service, or owned by any third party, or any other commission of any act of copyright, trademark, or patent infringement, trade secret infringement or misappropriation;

Legal Stuff

Square-Enix, Limited (Ltd.) holds the copyrights and trademarks for any and all related products, items, software, titles, icons, images, and so on and so forth inside Final Fantasy XI and all related items to such software.

Any infringement and violation of such copyrights and trademarks will be a violation of the following:

1. United States Copyright Law - Infringing on the copyrights owned by Square-Enix, Ltd. as stated in the EULA for Final Fantasy XI which includes all accounts, characters, and virtual assets in said game.

2. United States Trademark Law - Square-Enix, Ltd. holds the trademarks to anything and all products related and produced by Square-Enix. Using their trademarks such as the character that is a trademark of Final Fantasy XI; or the Gil that is a trademark of Final Fantasy; or the items inside the game are a trademark of Final Fantasy XI the software, which you are selling is a violation of such trademarks.

3. Digital Millennium Copyright Act - For the selling of digital copyright works without consent of the copyright owner, Square-Enix, Ltd.

4. No Electronic Theft (NET) Act - Because of having no consent from Square-Enix, Ltd., selling of anything digital that belongs to Square-Enix, Ltd. will be considered theft, and as such, can be prosecuted to the fullest extent of the law.

5. Copyright Law of Japan - Nation of origin where the original copyright existed and created, and is thus a violation of their copyright law

6. European Union Copyright Directive - Those who use and play the European version of Final Fantasy XI in a country belonging to the European Union, and the selling of accounts, characters, and items created within the European Union is therefore a violation of the EU Copyright Directive and Square Enix of Europe's copyrights held there.

7. Countries with treaties with and/or copyrights and trademarks inside the United States - Any copyright belonging to a country in a treaty with the United States or is a member of WIPO (World Intellectual Property Organization) is also valid within this country. As such, any violation of that copyright or trademark is also an infringement of US Copyright and Trademark laws. If caught, Square-Enix, Ltd. has the right to punish and prosecute any person or persons, including any business in the trade of or selling of infringing materials bought and sold inside the United States.

Punishment of copyright infringement: (Other than being banned from KillingIfrit...)
- A fine of no more than $500,000 USD or imprisonment up to 5 years in US jail, or both, for the first offense.

- A fine of no more than $1,000,000 USD or imprisonment up to 10 years in US jail, or both, for repeated offenses.


For Existing Users of KillingIfrit

If you believe you have witnessed a violation of the Final Fantasy XI User Agreement and/or the Code of Conduct whereby someone is advertising the selling of their account, character(s), and/or virtual assets that belong to Square-Enix, Ltd.; which includes and not limited to someone posting such advertisement on this website, you are to report the violation to the Special Task Force and to the Moderators of KillingIfrit.
